4. HOW WE SHARE YOUR INFORMATION

We may share your information in the following circumstances. Optional Meta tracking on selected public marketing pages shares browser and event information after your explicit Meta cookie choice, as described in Section 4.6.

4.1 Service Providers

We share information with third-party vendors and service providers who perform services on our behalf, including:

Cloud hosting and infrastructure providers
Payment processors
Analytics providers
Customer support tools
Email and communication services

These providers are contractually obligated to use your information only to provide services to us and are prohibited from using it for their own purposes.

4.2 Lead Generation Data Providers

For our Lead Generation Services, we work with third-party data providers to obtain Skip Tracing Data. Information about properties and service areas may be shared with these providers to facilitate data matching. See Section 6 for more details.

4.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency), including to:

Comply with a legal obligation
Protect and defend our rights or property
Prevent or investigate possible wrongdoing
Protect the personal safety of users or the public

4.4 Business Transfers

If Pool Runs is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

4.5 With Your Consent

We may share your information with third parties when you give us explicit consent to do so.

4.6 Optional Meta Advertising and Measurement

If you choose Allow Meta cookies, we load Meta's browser Pixel on selected public Pool Runs marketing and demo pages. It sends a PageView for eligible page visits and a Lead when a new demo request is successfully saved. A Lead is a demo request, not a confirmed meeting, account registration, trial, or purchase.

Meta receives the eligible page and referring URLs, approved static campaign parameters (utm_source, utm_medium, utm_campaign, and utm_content), format-validated Meta click identifiers (fbclid) when present, IP address, browser and device information, and cookie or browser identifiers (including _fbp and _fbc when available). A Lead also includes an independent random event identifier. Pool Runs uses this information for advertising and measurement. Meta may also use it for other personalization, as described in Meta's Privacy Policy.

Our integration does not include names, email addresses, phone numbers, form contents, business details, or customer records in its event payloads. It does not track authenticated product activity or enable automatic advanced matching or automatic events. Our code permits only selected public paths and approved attribution parameters; other query parameters and URL fragments block our tracking.

Meta's script runs in your browser with normal access to the page, including its content, URL, and referrer. These controls do not isolate third-party code from the page. See Section 9 for your choices and withdrawal controls.

5. SMS/TEXT MESSAGING AND MOBILE INFORMATION

5.1 Collection of Mobile Information

When you opt in to receive SMS or text messages from Pool Runs, we may collect your mobile phone number, your consent to receive messages, and information about your messaging preferences.

5.2 Use of Mobile Information

We may use your mobile phone number to send you SMS or text messages related to:

Account notifications and alerts
Service updates and reminders
Appointment confirmations and scheduling
Billing and payment reminders
Promotional offers and marketing communications (with your express consent)

5.3 Protection of Mobile Information

Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may share your mobile information only with service providers who assist us in delivering SMS messages (such as our messaging platform provider), and these providers are contractually prohibited from using your information for any purpose other than delivering messages on our behalf.

5.4 Opt-Out

You may opt out of receiving SMS or text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a final confirmation message, and no further messages will be sent unless you re-subscribe. You may also contact us at [email protected] to opt out.

5.5 Message Frequency and Rates

Message frequency varies based on your account activity and preferences. Message and data rates may apply depending on your mobile carrier and plan. Pool Runs is not responsible for any charges incurred from your mobile carrier.

6. LEAD GENERATION AND SKIP TRACING DATA

6.1 How Skip Tracing Works

Our Lead Generation Services use third-party data providers to obtain contact information and property data ("Skip Tracing Data"). When you use these features:

We may share limited information (such as geographic areas or property addresses) with data providers to obtain matching records
Skip Tracing Data is provided to you through the Service
We do not independently verify the accuracy of Skip Tracing Data

6.2 Your Responsibilities

As outlined in our Terms of Service, you are solely responsible for:

Your use of Skip Tracing Data
Complying with all applicable laws (including TCPA, FCRA, CAN-SPAM, and Do-Not-Call regulations)
Obtaining any necessary consents before contacting individuals

6.3 Skip Tracing Data is Not a Consumer Report

Skip Tracing Data provided through our Service is NOT a consumer report under the Fair Credit Reporting Act (FCRA) and may not be used for credit, employment, insurance, housing, or other FCRA-regulated purposes.

7. DATA RETENTION

We retain your information for as long as your Account is active or as needed to provide you with the Service. We may also retain and use your information as necessary to:

Comply with legal obligations
Resolve disputes
Enforce our agreements
Protect our legal rights

When you close your Account, we will delete or anonymize your information within a reasonable timeframe, unless we are required to retain it for legal or legitimate business purposes.

Customer Data: Upon Account termination, we may retain Customer Data for up to 90 days before deletion to allow for Account recovery or data export. After this period, Customer Data will be permanently deleted.

8. DATA SECURITY

We implement reasonable administrative, technical, and physical security measures to protect your information, including:

Encryption of data in transit and at rest
Access controls and authentication requirements
Regular security assessments
Employee training on data protection

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

If you believe your Account has been compromised, please contact us immediately at [email protected].

9. COOKIES AND TRACKING TECHNOLOGIES

9.1 Types of Cookies We Use

Essential Cookies: Required for the Service to function properly (e.g., authentication, security).

Analytics Cookies: Help us understand how users interact with the Service to improve functionality and user experience.

Preference Cookies: Remember your settings and preferences.

Marketing Cookies: If you choose Allow Meta cookies, Meta may store or read cookie and browser identifiers for advertising, measurement, and personalization, as described in Section 4.6.

9.2 Your Cookie Choices

Most web browsers accept cookies by default. You can usually modify your browser settings to decline cookies if you prefer. However, disabling cookies may affect the functionality of the Service.

On our public marketing pages, optional Meta tracking stays off until you choose Allow Meta cookies in the separate Meta notice. A previous general cookie choice or the general Accept All button does not authorize this integration. Select Keep Meta off to decline, or reopen Cookie Settings to change or withdraw your choice. Withdrawing marketing consent also withdraws your Meta choice.

Withdrawal stops our integration's future PageView and Lead commands and requests consent revocation from Meta's Pixel. Already loaded third-party code cannot be unloaded from the page by a consent change, and withdrawal does not recall information already received by Meta. Reload the page after withdrawing to start with Meta off.

9.3 Do Not Track

Some browsers offer a "Do Not Track" (DNT) feature. Our Service does not generally respond to DNT signals; the optional Meta integration on our public marketing pages is an exception. When our Meta integration checks consent, a supported DNT signal with the value 1 or a supported Global Privacy Control signal indicating an opt-out blocks Meta script loading and our PageView and Lead commands, even after a previous Meta cookie grant. If Meta's Pixel is already loaded, we also request consent revocation. This statement covers the optional Meta integration, not other Service features or tracking providers. You can manage your privacy preferences through Cookie Settings.

10. YOUR PRIVACY RIGHTS

Depending on your location, you may have certain rights regarding your personal information:

10.1 Access and Portability

You may request access to the personal information we hold about you and receive a copy of your data in a portable format.
